Bond P et al. – It is reasonable to assume that everyone makes mistakes at one time or other in his/her life, and such errors are therefore not necessarily negligent acts that require prosecution. If a mistake does happen it is up to the court to decide on the basis of expert evidence whether the practitioner is guilty of legal negligence or not.
